Terms of Service
Announced: 2 November 2026 · Effective: 9 November 2026
Article 1 (Purpose)
These Terms set out the rights, obligations and responsibilities of DeepDive Labs (Korean name: 딥다이브랩; the "Company") and its users, and other necessary matters, in connection with the use of the Dailying service (the "Service") provided by the Company.
Article 2 (Definitions)
① "Service" means the Dailying mobile application and all related services provided by the Company.
② "User" means any member or non-member who uses the Service under these Terms.
③ "Member" means a person who has entered into a service agreement with the Company and has been given a user account.
④ "Content" means any information, including text, voice and images, that a User creates, posts or sends within the Service.
Article 3 (Effect and Amendment of these Terms)
① These Terms take effect when they are posted on the Service screen or otherwise made known to Users.
② The Company may amend these Terms to the extent permitted by applicable law. When these Terms are amended, the Company will give notice of the amended Terms and their effective date through an in-app notice or in-service notification at least 7 days before the effective date. Amendments that are unfavorable to Users will follow any additional requirements of the law applicable to the User (for users in Japan, Article 548-4 of the Civil Code).
③ If a User does not agree to the amended Terms, the User may stop using the Service and delete their account. If the User continues to use the Service after the effective date of the amended Terms, the User is deemed to have agreed to the amendment.
Article 4 (Content of the Service)
The main features of the Service are:
- Voice chat (voice messages) and voice calls
- Anonymous sharing of everyday moments
- Community features
- Other services the Company develops or provides through partnerships
Article 5 (Formation of the Service Agreement)
① The service agreement is formed when a User agrees to these Terms and applies for membership, and the Company accepts the application.
② The Company may refuse an application, or terminate the service agreement afterwards, if:
- the applicant used another person's information;
- the applicant provided false information;
- the applicant is under 19 years of age (the Service may be used from the applicant's 19th birthday in Korean time; this applies regardless of country or region of residence);
- the applicant was previously restricted from using the Service for violating these Terms and is applying again; or
- the applicant otherwise does not meet the Company's eligibility requirements.
③ The Company checks age using the date of birth entered at sign-up and the identity verification result. If identity verification after sign-up shows that a User is under 19, the Company may, instead of terminating the service agreement, restrict sending voices, replying, calling, posting in the community and payments until the day the User turns 19, and will lift the restriction on that day. The User may delete their account at any time during this period.
Article 6 (User Obligations)
Users must not:
- collect, store or disclose another person's personal information without permission;
- post or send obscene, violent, abusive, hateful or discriminatory content through the Service;
- harass, threaten or stalk another person;
- interfere with the stable operation of the Service;
- use the Service for commercial purposes without the Company's prior consent;
- defame another person or infringe their rights;
- use the Service for illegal or improper purposes;
- copy, distribute or commercially use information obtained through the Service without the Company's prior approval; or
- otherwise violate applicable law or the usage rules set by the Company.
Article 7 (Restriction of Use)
① If a User breaches Article 6, the Company may, after prior notice, restrict the User's use of the Service or terminate the service agreement. In urgent cases, the Company may act without prior notice and will notify the User afterwards.
② The specific grounds, procedures and duration of restrictions follow the Company's operating policy.
③ A User who objects to a restriction may file an objection with the Company. The Company will review it and lift the restriction if the objection is justified.
Article 8 (Changes to and Suspension of the Service)
① The Company may change all or part of the Service for operational or technical reasons.
② If the content, method of use or hours of the Service change, the Company will give advance notice within the Service of the reason, the details and the date of the change.
③ The Company may restrict or suspend all or part of the Service in the following cases:
- when needed for system operation, such as scheduled maintenance, server expansion or replacement, or network instability;
- when normal service cannot be provided because of a power outage, equipment failure, traffic surge or similar event; or
- in the event of force majeure, such as natural disasters or national emergencies.
Article 8-2 (Paid Services and Cookies)
① "Cookies" are in-service usage credits that Users spend to use paid features within the Service. There are "Paid Cookies," purchased through app marketplace billing (App Store, Google Play), and "Free Cookies," given by the Company at no charge through events, rewards and the like.
② Cookies can be used for the features shown on the Service screen, such as opening a received reply or requesting or extending a voice call. The number of Cookies required for each feature, and the number of free uses, are shown on the relevant screen.
③ Cookies cannot be exchanged for cash or transferred to another Member.
④ If the Company changes which features use Cookies or how many Cookies they require, it will give notice through an in-app notice at least 7 days before the change takes effect. Cookies already purchased can continue to be used under the new rules.
⑤ Any remaining Cookies expire when a Member deletes their account and cannot be restored.
⑥ Prices are displayed on each purchase screen (App Store / Google Play) in local currency. For users in Japan, prices include consumption tax.
Article 8-3 (Withdrawal and Refunds)
① A User may request withdrawal (a refund) for unused Paid Cookies within 7 days of the purchase date. If some of the Paid Cookies have been used, only the unused portion can be refunded.
② Cookies already used, and features already used with them (replies opened, calls connected, etc.), are not refundable.
③ Free Cookies are not refundable. If a User holds both Paid and Free Cookies, the Company calculates the refundable Paid Cookies based on payment records.
④ Refunds can be requested through the refund process of the marketplace where the purchase was made (App Store purchase history, Google Play order history) or through customer support (support@dailying.kr), and may be handled according to the marketplace's policies.
⑤ If a minor (as defined by the law applicable to the User) made a payment without the consent of a legal guardian, the minor or the guardian may cancel it as permitted by that law. This does not apply if the minor used deception to make others believe they were an adult or had the guardian's consent.
Article 9 (Management of Content)
① Rights and responsibilities for Content that a User posts within the Service belong to that User.
② The Company may delete, or restrict access to, Content posted by a User without prior notice if it:
- infringes the rights of other Users or third parties;
- violates applicable law; or
- violates these Terms or the Company's operating policy.
③ Voice calls are processed by real-time streaming and are not recorded or stored on servers. Voice messages exchanged in 1:1 chat rooms and voice posts (New Voices, Topics, Missions, the Ideal Type World Cup, etc.) are stored on servers so they can be played back; their retention and deletion follow the Privacy Policy (1:1 voice messages are kept while the chat room exists, for up to 3 years, and deleted when the chat room is deleted or the member deletes their account).
Article 10 (Intellectual Property)
① Copyright and other intellectual property rights in the Service belong to the Company.
② Users may not copy, transmit, publish, distribute, broadcast or otherwise use information obtained through the Service, or allow third parties to do so, without the Company's prior consent.
③ Copyright in Content that a User posts within the Service belongs to that User. However, the Company may use Users' Content to operate, improve and promote the Service. The Company features a User's voice on its official social media accounts or in promotional content only if the User has given separate consent (see "Use on Official Social Media and in Promotion" in the Privacy Policy).
Article 11 (Termination and Account Deletion)
① Users may request account deletion at any time through the in-app settings, and the Company will process it immediately.
② Personal information after account deletion is handled according to the Privacy Policy.
③ Content a User has posted within the Service may not be deleted when the account is deleted. Users who want their Content deleted should delete it themselves before deleting their account.
Article 12 (Disclaimers)
① The Company is not liable when it cannot provide the Service due to force majeure, such as natural disasters, war, or suspension of service by telecommunications carriers.
② The Company is not liable for service disruptions caused by reasons attributable to the User.
③ The Company is not liable if a User does not obtain the results they expected from the Service, or for information obtained through the Service.
④ The Company has no obligation to intervene in disputes between Users, or between a User and a third party, arising through the Service, and is not liable for damages arising from such disputes.
⑤ The provisions of this Article and any other provisions of these Terms that exclude or limit the Company's liability do not apply in cases of the Company's intent or gross negligence, or to the extent they are invalid under mandatory consumer protection laws applicable to the User (including Japan's Consumer Contract Act).
Article 13 (Damages)
① If the Company or a User causes damage to the other party by breaching these Terms, that party is liable for the damage.
② If the Company sets the scope of damages in separate terms or policies for an individual service, those provisions apply first.
Article 14 (Dispute Resolution)
① Lawsuits concerning disputes between the Company and a User are governed by the laws of the Republic of Korea. If the User is a consumer, this does not deprive the User of the protection of mandatory provisions of the law of the country where the User habitually resides.
② If a dispute arises between the Company and a User in connection with the Service, both parties will consult in good faith to resolve it.
③ If the dispute is not resolved through consultation, a lawsuit may be filed with the competent court under the Civil Procedure Act of the Republic of Korea. This does not prevent a consumer User from bringing a claim in the courts of their country of residence where that country's law allows it (for users in Japan, under the Code of Civil Procedure of Japan).
